Asbestos families to receive compensation from insurance firms

Up to £600 million could be paid to relatives of asbestos victims after a landmark victory in the Supreme Court.

The court ruled that asbestos victims could now claim for insurance when they had been exposed to asbestos dust – rather than previously where they had to exhibit symptoms first.

The Mirror Newspaper has been driving a campaign entitled the Mirror’s Asbestos Timebomb which is pushing for victims of asbestos poisoning to receive adequate payouts.

For one family the action group Union Unite launched a legal challenge on behalf of a man, Charles O’Farrell who died in 2003.

His daughter said she just wanted justice after her father passed away without being able to enjoy his retirement.

“All I ever prayed for was the right decision. This is the right decision,” she said.

“My dad worked all his life and hoped to enjoy retirement but mesothelioma took him away.

“There was never any question about who was to blame. This long battle was all about insurers wanting to get out of paying.”

Unite general secretary Len McCluskey believes it’s a disgrace that insurance firms are so quick to shirk their responsibilities.

“For callous insurers this means the responsibility is over,” he said.

The ruling will now pave the way for more asbestos victims to consider making a claim against their insurers.

Claiming compensation as an asbestos victim

Asbestos is one of the most dangerous and potentially lethal substances that you could ever come into contact with, and in most situations serious, prolonged exposure to this type of substance leads to very serious injuries and even death. Although asbestos is rare in modern society, any buildings which are several decades old can still contain remnants of the substance. In addition, if you have previously worked in an environment where you have been surrounded by asbestos then you may soon start to exhibit symptoms which can take years to show.

If you have suffered from asbestos through not being provided with the appropriate safety equipment, training, or because you were working in an unsafe environment, then you could be eligible to make a compensation claim against your employer for negligence.
