If you suffer a road traffic accident which was your friend’s fault then he will have insurance which should cover your expenses and award you damages for your injury.  If you have an accident in a friend’s home then they have a duty of care to ensure their home is safe for those who enter their home.  It may be the case they have some form of home insurance which you can claim against.

What kind of accident can I claim compensation for?

A driver of a car has a duty to drive safely and with regard to any passengers and any other drivers on the road.  If the driver breaches that duty then he is negligent in that duty.  If the negligence has caused an injury and the injury has resulted in any loss then you are entitled to claim for compensation.

If you have an injury in the home of a friend you can have any number of accidents, from slipping over on badly laid tiles in their drive to being scolded by a faulty tap.  Of course, common sense plays a large part, and if a reasonable person would not have been injured and the injury is not your friend’s fault then a compensation claim would be difficult to achieve.

However, if a reasonable person would have been injured and it was the fault of your friend then you have a right to claim compensation for the injury.

Don’t feel bad! In the first place your friend may have insurance to cover a claim, so will not be out of pocket.  Secondly, you do not claim compensation to punish someone.  Compensation is your right, and if you suffer in an accident which is not your fault then you are entitled to the compensation you deserve.
