Claiming Compensation Against a GP

When you go to see your GP you expect that they will be able to offer you advice and a treatment plan to cure any ailment that you have. Unfortunately, just like us GP’s are human and therefore they do make mistakes. The problem is that these mistakes can often lead to serious health conditions and end up leaving patients worse off than they were originally.

Although GPs are here to help, if they do in fact make your personal situation worse then you may be eligible to make a claim. In fact it has been reported that in the last decade we have seen over a ten times rise in claims against General Practitioners. If you have suffered at the hands of mis-information or treatment then you may be eligible to claim for medical damages and any additional loss of income.

What can go wrong?

GP’s deal with a variety of medical cases each year and although they are experts in their given field, this field is quite broad and is not tailored to deal with specific medical issues – this is why we have specialists. If you have a very specific illness your GP may not be able to offer you the advice that you require, or may offer you incorrect advice which leads to you taking the wrong medication.

The situation could worsen if you have a potentially life threatening disease and it is not identified by your GP, or alternately it is cast aside as something minor that will “heal itself with a few weeks of rest”. This kind of negligence can lead to serious health issues down the track and potentially heavy costs to you as the patient.

When can I make a health claim?

If you believe that you have suffered medical negligence at the hands of your GP you may be eligible to make a claim. Examples of potential claims include:

  • Incorrect diagnosis – If you are incorrectly diagnosed then your injury could take an extended period of time to heal costing you more money and time off work
  • Incorrect prescriptions – If you are given the wrong medications this could hamper your efforts to treat your illness, or if you haven’t been properly checked, could potentially have an allergic reaction to any of the ingredients
  • Not recognising a serious illness – If you contract a serious illness and it isn’t identified this can lead to further problems down the track.

How do I make a claim?

If you feel that you have suffered as a result of visiting your local GP, then you may be eligible to make a claim to cover your expenses. If you have suffered medical negligence then you could be entitled to compensation which covers any medical expenses in addition to any potential loss of income you have suffered.
