Claiming Compensation On Slips & Trips

Claiming Compensation On Slips and Trips

Summer is in the air and it’s the holiday season for millions of Brits. But for those of you jetting off to lands afar, or indeed those who have returned home recently, did you know that you still have many of the same legal rights as you do in the UK when it comes to claiming for slips, trips and falls while abroad?

Suffering an injury on holiday can be miserable. Not only do you have to put up with the pain caused by the injury, but you also have the trauma of being in an unfamiliar place many miles from home.

But what many people fail to realise is that if you suffer an injury from a slip, trip or fall outside the jurisdiction of the UK, you may still be able to make a compensation claim back home when you return to the UK. Read on to find out more...

I was booked on a package holiday and suffered an injury, can I claim?
You can make a personal injury compensation claim if:

  • you were injured on a package holiday and suffered the injury within the confines of your hotel or resort.
  • you suffered the injury on an organised excursion.
  • you were using a car supplied by the tour operator.
  • you were using any other facility supplied, promoted or controlled by your tour operator.

Remember – if you are on a package holiday, you can claim against the tour operator in the UK. In some cases you can also claim against the travel agent.

What if I didn’t book a package holiday? Can I still claim?
If you are travelling independently it does become more difficult, but not necessarily impossible. It may still be possible to make a claim against the person or organisation responsible for your injury. Please contact one of our experts for more details.

Key documents to collect if you have an accident abroad:

  • as many photographs as possible
  • the company holiday brochure
  • witness contact details
  • as many booking documents as possible – your confirmation email, your bill etc
