Compensation for inadequate care

When it comes to making a personal injury claim many people feel that they have to be very injury specific, but this is not always the case. In some situations you may choose to make a claim for general inadequate care. This could be in a hospital environment where you feel you have been poorly treated throughout your stay, or even in a care home where you feel that you may be neglected on a day to day basis.

Inadequate care is a very valid reason for a compensation claim and if you feel that your inadequate care has led to you developing further injuries and illnesses then you could be eligible to make a compensation claim to recoup any damages that you have incurred.

What are some examples of situations where I could claim for inadequate care?

There are many situations where you may be eligible to claim for inadequate care and some of these include:

  • Care homes – if you feel that you have been poorly cared for in a care home you could be eligible to make a claim
  • Hospitals – if you have received poor treatment in a hospital environment, including personal neglect then you could be eligible to make a claim
  • Rehabilitation – if you have received poor rehabilitation it could have increased your recovery time from an illness
  • Surgery – if you feel that inadequate care has been given during your surgery and you have been left with an injury or infection as a result then you could be eligible to make a claim for compensation.

Who can I claim against?

When it comes to claiming for inadequate care there are a number of people who you could choose to claim against and this depends on the circumstances of your inadequate care. If the negligence occurred in a care home or other care facility then you may be eligible to claim against a carer or a care home owner if you feel that the facilities were poor and you were injured as a result.

Alternately if you have received inadequate care in a hospital environment then you may be eligible to claim against a doctor or nurse who may have been negligent towards you. In this environment it could have been a lack of food and water, lack of correct medication or the failure to administer painkillers which have contributed to your inadequate care.
