How do I know if I have a Personal Injury Claim?

It is really as simple as it sounds – if you or someone close to you has been injured, emotionally, psychologically or physically then you have suffered a personal injury!  However, this does not mean you can claim compensation for any personal injury.  If the injury is not your fault, and was caused by the negligence of another person, then you may be able to claim compensation against that person.

That person does not have to be a ‘physical person’  - it can be a company, a government, a council or any other type of entity.  These are known as ‘legal persons’.

What types of injury are classes as personal injury?

This can be any type of injury caused by an accident, including car accidents, accidents in the home or at work, accidents caused by defective products or medicines, or injuries caused by professionals, including dentists or doctors.  If you have medical or dental treatment and the medical professional injures you through their negligence (by not adhering to their professional standards) then you may have a claim for compensation.

If you have contracted an illness by the fault of another person then this is also a personal injury where you may be able to make a claim.  For example, if your workplace has asbestos insulation and you contract asbestosis because it has not been cleared properly, then your disease is caused by your employer’s negligence and you can claim for your losses and other damages.  Your employer has an obligation to ensure employees have a safe place in which to work, which means keeping it free of hazards and keeping it clean.

How long do I have to claim compensation for personal injury?

The basic rule is that you have 3 years after the injury to make a claim for compensation.  There are however exceptions to this rule, and if you became aware of the injury several years after the original accident (for example, in the case of psychiatric injury or industrial injury such as asbestosis) then you may still be able to claim compensation.  For this reason it is very important you contact us at Manners Pimblett free of charge and we can assess whether you have a valid claim for compensation.
