Injured at work

Is it time to consider a claim against your employer? If you have suffered an injury at work and it can be proven that negligence has occurred then you may have grounds for a personal injury claim. This Manners Pimblett article looks at work related injuries, accidents in the workplace and making a no win no fee claim.

Musculoskeletal disorders

  • Most work related personal injuries in 2008 were musculoskeletal disorders. These are injuries affecting the back, upper limbs, neck and lower limbs.
  • Neck injuries are normally caused as a result of using a vehicle for work purposes and being involved in a car or traffic accident. Cricked neck or whiplash normally is the result of seat belt use.
  • Back injuries are found to be caused by incorrect moving and handling techniques. Lack of training in the work place can lead to increased back pain and or related working injuries.
  • Shoulders and arms tend to become caught in unguarded machinery. A percentage of industrial accidents are direct result of machines, lathes, mills and presses that are unguarded during operation. Or the worker has not received appropriate training to be able to competently use the machine. Cuts and abrasions are often unreported or receive minimal medical care.
  • Lower limb injuries in the workplace are normally the result of inadequate safety policy. Crushing injuries as a result of unsafe fork lift truck use and incorrect loading of racking and shelving in warehouse environments can lead to damage and injury to legs and or feet.

Negligence in the workplace

To be able to prove that an accident claim for an injury is worth pursuing it is important to identify that negligence has occurred. So claiming for a self inflicted paper cut in the workplace is out of the question. However if you are injured though lack of appropriate maintenance of a work tool or inappropriate policy and procedure, then you may have grounds for an accident claim against your boss or employer.
