Man who suffered brain damage at birth receives £3 million payout

After a 20 year legal battle a man has won compensation over a brain damage he suffered at birth.

The man claimed that blunders at Fairfield Hospital in Bury led to the man developing cerebral palsy which now means that he must receive round-the-clock care for both learning and behavioural difficulties.

It was argued that his disabilities were caused when he was starved of oxygen during his birth.

Although the hospital has not accepted responsibility for the accident, they have agreed to pay half of the initial compensation amount which will go towards his care and any changes that need to be made to his housing.

Adam’s parents have discussed the problems that the family have faced dealing with his condition.

“The past 24 years have been incredibly difficult for the family and we have some tough times ahead, but to know that we have the means to be able to support Adam is an immense relief,” said his mother Jacqueline.

“However, we don’t want any other families to go through the same situation, so we hope that Adam’s case will demonstrate the devastating effects that birth injuries can have and improve levels of care for pregnant women.”

Claiming compensation for injuries sustained at birth

When it comes to giving birth it can be an incredibly dangerous process for both the child and the parent, especially if the correct care isn’t given. It is the responsibility of the doctor, nurse, midwife or any medical professional who is present to ensure that both the baby and mother are given the best possible treatment throughout delivery to prevent any complications from arising, if this is not given and the baby or mother suffers injuries as a result, then they could be eligible to make a compensation claim.
